Terms of Service

1. Acceptance of Terms

By creating an account or using GuestWelcomePage (the 'Service'), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and GuestWelcomePage ('we', 'us', 'our').

2. Description of Service

GuestWelcomePage is a SaaS platform that allows hospitality operators to create mobile-first digital guest guides accessible by link or QR code. The Service includes AI-assisted content creation, multilingual guest pages, and analytics features depending on your plan.

We reserve the right to modify, add, or remove features at any time. We will communicate material changes that affect your use of the Service.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 18 years old to use the Service. Accounts may not be shared across multiple organisations without an Enterprise plan. One account per person.

4. Subscription Plans

The Service is offered on the following paid plans: Starter (1 property, €7.99/month or €79.90/year) and Pro (up to 5 properties, €19.99/month or €199.90/year). Enterprise plans are available with custom pricing for larger portfolios. Plan features and limits are described on the pricing page.

We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect your current billing period. If you do not agree to a price change, you may cancel before the new price takes effect.

5. Free Trial

New accounts receive a 30-day free Pro trial. No payment method is required to start the trial. The trial gives you access to all Pro features during the trial period.

At the end of the trial, access is restricted unless you subscribe to a paid plan. We will notify you before your trial expires. No charges are applied if you do not subscribe.

6. Billing and Payments

Subscriptions are billed in advance on a monthly or yearly basis. Payments are processed securely by Stripe. By subscribing, you authorise us to charge your chosen payment method at the start of each billing period.

Subscriptions renew automatically unless cancelled before the renewal date. If a payment fails, Stripe will retry the charge up to four times over approximately three weeks. You will receive email notifications of failed payments. If payment cannot be collected after all retries, your subscription will be cancelled and access will be restricted.

All prices are in EUR and exclude applicable taxes. If VAT or other taxes apply to your purchase, they will be shown at checkout.

7. Cancellation and Refunds

You may cancel your subscription at any time through the billing portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period — you retain full access until then.

We do not offer refunds for partial subscription periods, except where required by applicable law (for example, the EU 14-day right of withdrawal for digital services, where applicable). If you believe you are entitled to a refund, contact us at [email protected].

8. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You must not: use the Service to publish content that is illegal, defamatory, harassing, or infringes third-party rights; attempt to gain unauthorised access to any part of the Service; use the Service in a way that could damage, disable, or impair it; attempt to reverse-engineer the Service.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on the severity of the violation.

9. Your Content

You retain ownership of the content you create and publish through the Service. By publishing content, you grant us a limited licence to host, display, and deliver it to guests as part of the Service. You are solely responsible for ensuring that your content complies with applicable law, does not infringe third-party rights, and is accurate for your guests.

10. Intellectual Property

The GuestWelcomePage platform, including its design, code, and features, is owned by us and protected by intellectual property law. Nothing in these Terms transfers ownership of the platform to you. You receive a limited, non-exclusive, non-transferable licence to use the Service during your subscription.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

12. Termination

You may terminate your account at any time by deleting it from account settings. We may suspend or terminate your account if you breach these Terms. Upon termination, your access to the Service ends. Your content and data will be deleted within 30 days of account deletion, except for financial records retained as required by law.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-product notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Italy. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Italy, unless mandatory consumer protection law in your country of residence provides otherwise.
